Our role is strictly limited to physically witnessing your signature — we do not provide legal advice, draft documents, or accept legal liability for document content.

Do You Need a Witness?

Certain legal documents in Texas require one or more witnesses to be present during signing in addition to notarization. These include:

Texas Law Requirements for Witnesses

Texas law has strict requirements about who can and cannot serve as a witness on legal documents. Please review carefully before bringing your own witness to your appointment.

A qualified witness in Texas MUST:

  • Be 18 years of age or older
  • Be of sound mind and full legal capacity
  • Have no financial interest in the document being signed
  • Have no beneficial interest in any estate trust or transaction referenced in the document
  • Present a valid unexpired government-issued photo ID for identity verification
  • Be physically present for the entire signing ceremony from start to finish
  • Be available to appear in court or any legal proceeding if required

A witness CANNOT be:

  • A family member of the signer including spouse child parent or sibling
  • A beneficiary named anywhere in the document
  • Anyone whose name appears in the document in any capacity
  • Anyone with a financial interest in the outcome of the document
  • The notary public performing the notarization

You are welcome to bring your own witness to your appointment. Please ensure your witness meets every Texas legal requirement listed above before your appointment date. If your witness does not qualify under Texas law the notarization cannot be completed and your appointment may need to be rescheduled. The Complete Texas Witness Ceremony — Step by Step

At On Spot Mobile Notary we follow the complete and proper witness ceremony process as required under Texas law. Every step is performed correctly completely and in the proper legal order from start to finish.

Step 1 — Identity Verification Before the ceremony begins every witness presents a valid unexpired government-issued photo ID. The notary verifies and records the identity of every witness in the official notary journal as a permanent record.

Step 2 — Witness Qualification Confirmation The notary confirms every witness meets all Texas legal requirements — no family relationship to the signer, no beneficial interest in the document, no name appearing anywhere in the document, and full legal capacity.

Step 3 — Document Review The witness reviews the document to understand its nature and purpose. For a Last Will and Testament the witness confirms the self-proving affidavit is attached and present before proceeding.

Step 4 — Signer Identification and Capacity The notary verifies the identity and legal capacity of the signer. The signer must be of sound mind, acting voluntarily, and fully aware of what they are signing. The witness observes and confirms this as well.

Step 5 — Administration of Oath For documents requiring an oath the notary administers the oath to both the signer and witnesses. Both parties raise their right hand and verbally affirm or swear to the truthfulness and validity of the document and their signatures. This oath is a formal legal ceremony — not a formality.

Step 6 — Signing in the Presence of All Parties The signer signs the document in the physical presence of both the notary and all required witnesses simultaneously. No one may sign separately or at a different time. All parties must witness the actual act of signing in real time.

Step 7 — Witness Signature Immediately following the signer's signature each witness signs the document confirming they witnessed the signing ceremony, the oath administration, and the identity and capacity of the signer. The witness signs exactly as their name appears on their government-issued photo ID.

Step 8 — Notary Completion The notary completes the notarial certificate, applies the official seal, and records the complete transaction in the official notary journal including the names, ID details, and signatures of all parties present.

Self-Proving Affidavit Execution — Last Will and Testament Only

What Is a Self-Proving Affidavit?A self-proving affidavit is a special extra page attached to your Last Will and Testament. It is a separate sworn statement that makes your will stronger in the eyes of the court. Simply put — the will says what you want. The self-proving affidavit proves it was signed correctly.

Why Does It Matter?Without a self-proving affidavit the court may need to contact witnesses and ask them to testify in person during probate — causing delays, stress, and extra costs for your family. With it attached the court accepts the will as already verified. No witnesses are called. Probate moves forward quickly and smoothly.

What Happens at Your Appointment?

First Ceremony — Everyone gathers. Notary verifies all IDs. You sign the will in front of both witnesses. Witnesses sign confirming they saw you sign.

Second Ceremony — Notary administers a separate oath to you and both witnesses specifically for the affidavit:

To signer — Do you swear this is your Last Will, signed freely and voluntarily, and you are of sound mind? Signer answers yes.

To witnesses — Do you swear you witnessed this person sign freely, that they appeared of sound mind, and everything in this affidavit is true? Both witnesses answer yes.

Everyone signs the affidavit together. Notary seals it. Document is now legally complete and court ready under the Texas Estates Code.Witness Remains Present Until Completion. The witness must remain physically present until the notary declares the process complete. Early departure may invalidate the entire document.                         The following oath language is provided for general educational purposes only and reflects standard Texas notary ceremony practice under the Texas Estates Code. Actual oath wording may vary based on the specific document and circumstances.

Limitation of LiabilityOn Spot Mobile Notary and its witnesses shall not be held liable for any legal dispute, rejection, or outcome arising from any witnessed document. Liability is strictly limited to proper performance of the witness signature ceremony under Texas law.

Governing LawAll witness services are governed by Texas law including the Texas Estates Code, Texas Civil Practice and Remedies Code, and Texas Government Code.
